The Indian Nyay Samhita created two distinct categories of death by negligence.

The first category refers to those who cause death by any careless or negligent act not amounting to culpable homicide. Offenders in this category face a prison sentence of up to five years and a fine. The second category relates to causing death by reckless and careless driving, not the basis of culpable homicide. If a person avoids immediately reporting the incident to the police or the municipality, he can be punished with up to 10 years in prison and a fine.

Despite the law’s intent, experts have highlighted the need for more clarity on how a suspect or driver should report to authorities, given the potential risk of public outrage at crash scenes. In addition, safeguards are required to prevent the possible use of this provision.

Road safety experts say there is a need to define the type of evidence that can be accepted to corroborate the claims of victims or accused persons and prevent their possible use.
